1. Service Description

1.1 What SpeakSights Provides

SpeakSights is a B2B AI voice assessment platform that enables hiring organizations to screen and evaluate candidates' communication skills through structured voice assessments. The platform provides:

Configurable question sets tailored to role types (sales, BPO, customer service, etc.)

Candidate Management

Invite candidates, track status, manage roles and pipelines

AI Voice Analysis

7-dimension scoring: clarity, vocabulary, pace, grammar, confidence, accent comprehension, content relevance

Dashboard & Reports

Structured results with scores, recommendations, and side-by-side comparison

Pipeline Management

Shortlist, review, archive candidates with hiring stage tracking

Team Collaboration

Role-based access for admins, recruiters, and hiring managers

1.2 Important Limitation

SpeakSights provides a screening tool, not a hiring decision. Assessment scores represent one data point. Hiring decisions remain the sole responsibility of your organization. We do not guarantee candidate performance, retention, or fit. Always use assessments alongside interviews, references, and other evaluation methods appropriate for the role.

2. Agreement to Terms

By creating an organization account on SpeakSights, you agree to these Terms of Service on behalf of your organization. The individual signing up represents they have authority to bind the organization to these terms.

Incorporated Documents: These Terms incorporate the Data Processing Agreement (DPA) and Privacy Policy. All three documents together constitute the complete agreement between your organization and SpeakSights AI.

3. Trial Period & Subscription

The trial period begins on account creation. Upon trial expiry, your account enters read-only mode. Existing assessment data remains accessible. No new assessments can be run until a subscription is activated.

3.2 Subscription Plans

Subscription plans are offered on monthly or annual billing cycles. Plan details, candidate limits, and pricing are published on our pricing page and may be updated with 30 days' notice.

4. Organization Responsibilities

As the Data Controller, your organization bears the following responsibilities when using SpeakSights:

Lawful Basis for Processing

You must establish and document a lawful basis under GDPR Article 6 for processing candidate personal data before inviting candidates. Acceptable bases include: candidate consent (Article 6(1)(a)), legitimate interests in employment screening (Article 6(1)(f)), or pre-contractual necessity (Article 6(1)(b)).

Candidate Notification

You must provide candidates with a privacy notice about the assessment before they participate. SpeakSights provides a built-in consent step on the candidate assessment page; this does not replace any additional notice obligations your organization may have under employment law.

Non-Discriminatory Use

You must use assessment results in a non-discriminatory manner consistent with applicable employment law in your jurisdiction. SpeakSights scores communication skills only. You may not use SpeakSights to screen on the basis of accent, national origin, or any protected characteristic.

No Special Category Data

You must not use SpeakSights to collect or process special category personal data as defined in GDPR Article 9 (health conditions, disabilities, religious beliefs, racial origin, trade union membership, sexual orientation, etc.).

Account Security

You are responsible for maintaining the security of your organization's account credentials. Promptly notify us of unauthorized access at security@speaksights.com.

5. Data Ownership & Intellectual Property

Your Data (Organization)

Your organization owns all candidate data submitted through the platform — audio recordings, assessment results, candidate profiles, recruiter notes. SpeakSights holds a limited license to process this data solely to provide the service.

SpeakSights Platform

SpeakSights AI owns all platform software, AI models, scoring algorithms, assessment methodologies, brand, and intellectual property. You receive a limited, non-exclusive, non-transferable license to use the platform during the subscription term.

No AI Training: We will never use your candidate data to train AI models. OpenAI retains API data for up to 30 days for safety monitoring only (then auto-deleted) and does not use API data for model training. AssemblyAI applies PII redaction on all audio before processing.

5.4 Cookies & Analytics

We use Google Analytics 4 on public-facing pages (landing page, login, signup) to collect anonymized usage data (page views, geographic region, device type, referral source). No candidate data, assessment results, or personal identifiers are ever sent to Google Analytics. Analytics are activated only after explicit cookie consent and are never active inside the authenticated dashboard. 6. Acceptable Use Policy

Your organization agrees NOT to:

Use SpeakSights to screen candidates based on protected characteristics (race, gender, religion, disability, national origin, age, etc.)
Use assessment results as the sole or decisive factor in employment decisions without human review
Share platform access credentials with individuals outside your organization
Attempt to reverse-engineer, copy, or resell the SpeakSights platform or its scoring methodologies
Use automated scripts or bots to generate fake assessments or inflate scores
Upload malicious files or attempt to compromise platform security
Use the service in jurisdictions where AI-based employment screening is prohibited by law

7. Billing & Refund Policy

7.1 Billing

  • • Subscriptions are billed in advance at the start of each billing cycle (monthly or annual)
  • • Payments are processed securely through our payment processor — we never store your card details
  • • All prices are exclusive of applicable taxes, which will be displayed at checkout

7.2 Refund Policy

No refunds for started billing cycles

Once a billing cycle begins, no refunds are issued for that period. You may cancel at any time; cancellation takes effect at the end of the current billing cycle. The trial period is free with no obligation.

Refunds ARE provided for:

  • Technical failure preventing access to the platform for >72 consecutive hours
  • Duplicate charges due to payment processing errors
  • Charges made after confirmed account cancellation

7.3 Taxes & GST

All prices listed on our website are exclusive of applicable taxes. Goods and Services Tax (GST) or any other government-mandated taxes will be charged in addition to the listed price, as required under applicable law at the time of invoicing.

For Indian customers, GST will be applied at the prevailing statutory rate once SpeakSights AI becomes liable for GST registration under the CGST Act, 2017. SpeakSights AI will provide reasonable advance notice before GST is applied to existing subscriptions.

Founding Member Rates: Discounted pricing locked under the Founding Member Program refers exclusively to the base subscription fee. It does not include taxes. When GST or other taxes become applicable, they will be charged over and above the locked founding rate. This does not constitute a change to the locked rate.

7.4 Cancellation

You may cancel your subscription at any time from the billing section of your dashboard or by contacting support@speaksights.com. After cancellation, your account transitions to read-only mode at cycle end. Your data is retained for 90 days before deletion.

8. Service Availability & SLA

99.5% Uptime Target

Measured monthly, excluding scheduled maintenance windows announced 48 hours in advance.

Service may be temporarily unavailable due to:

  • • Scheduled maintenance (announced minimum 48 hours in advance via email)
  • • Emergency security patches
  • • Third-party service disruptions (AssemblyAI, OpenAI, Azure)
  • • Force majeure events

9. Termination

9.1 Termination by You

You may terminate at any time with no notice required. Cancellation takes effect at the end of the current billing cycle.

9.2 Termination by SpeakSights

We may terminate or suspend your account immediately (with notice) if:

  • Violation of these Terms or the Acceptable Use Policy
  • Non-payment of subscription fees after 14-day grace period
  • Activity that poses a security risk to the platform or other users

9.3 Data After Termination

Upon termination, your data enters a 90-day deletion window. You may request a data export within this period by emailing privacy@speaksights.com. After 90 days, all candidate personal data is permanently deleted. Written confirmation of deletion is provided upon request.

10. Disclaimers & Limitation of Liability

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. SPEAKSIGHTS DOES NOT WARRANT THAT THE SERVICE WILL BE ERROR-FREE OR UNINTERRUPTED. AI ANALYSIS MAY CONTAIN ERRORS AND SHOULD NOT BE USED AS THE SOLE BASIS FOR EMPLOYMENT DECISIONS.

10.1 No Guarantee of Hiring Outcomes

Assessment scores measure voice communication quality only. We do not guarantee that high-scoring candidates will perform well in the role, or that low-scoring candidates should be rejected.

10.2 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SPEAKSIGHTS' LIABILITY FOR ANY CLAIMS ARISING FROM THESE TERMS IS LIMITED TO THE SUBSCRIPTION FEES PAID BY YOU IN THE 3 MONTHS PRECEDING THE CLAIM.

11. Dispute Resolution & Governing Law

Before initiating formal proceedings, contact us at legal@speaksights.com to attempt informal resolution within 30 days.

Jurisdiction: Courts of Hyderabad, Telangana, India

GDPR obligations apply as a matter of EU law where EU residents' data is processed, regardless of governing law.
